The following Terms and Conditions shall apply to all users in relation to Buffet provided services through our application/website, whether accessed or used by you as a Service provider, Vendor or as the receiving party “Customer” and come into force once you accept an order or service through Buffet platform or through any other form of communications with Buffet.

Please note that you should review our Privacy Policy and these Terms carefully and immediately cease using our services if you do not agree to these Terms.

The “Customer” agrees and accepts that the use of the services provided by Buffet is at the sole liability of himself, and further acknowledges that Buffet disclaims all representations and warranties of any kind, whether express or implied.

PREAMBLE:

Whereas Buffet provides a technology platform in order to arrange and schedule restaurant reservations, catering booking and delivery services within the Arab Republic of Egypt through independent service providers, and whereas customers periodically require catering services or restaurant reservations for business meetings, family gathering or social events, Hence, Buffet is willing to arrange and provide such services through its technological platforms.

DEFINITIONS:

The following definitions apply to the terms and conditions set out below, These Terms and Conditions, along with the Privacy Policy, hereby sets out the whole agreement and understanding between Buffet and the “Customer” whether an individual or entity who access our services,

- “We”, “Us”, “Our”, “Buffet” shall refer to Buffet, its employees, authorized agents and its independent contractors and the entities that carry out or undertake to provide restaurant reservations, catering or delivery services hereunder or perform any other services within the scope of the provided services.

- “The Customer “, “Users”, “You “, “Your “, shall refer to the Buffet users whether individual or entity.

- “Third party", "providers “, shall refer to restaurants, catering services providers in agreement with Buffet.

- “Delivery “means the delivery and completion of the desired service under these terms and conditions.

- “Prohibited Items “means any goods or materials, of which is prohibited by any law, rules, and regulations in Egypt.

- “ Force Majeure “ mean an act of God, including but not limited to fire, floods, storms, hurricanes, typhoons, volcanic activities, or earthquakes, as well as acts, orders or requests of a sovereign or a government and /or of anybody purporting to be or to act for such authority, wars, whether declared or not, war-like actions, revolutions, riots , civil insurrections, or civil commotions , as well as strikes, lock outs, and/or similar actions in labor disputes, and any other comparable cause beyond the control of a party unless its performance has been expressly guaranteed by expressly waving the exemption of a Force Majeure event.

- “Customer “or “Client” shall refer to the recipient or addressee of the provided services under this terms and conditions.

REGISTRATION:

- As part of the registration process, you are required to provide us with certain information and to keep the information true, current, complete, and accurate at all times. The information includes but not limited to the following:

- Your full name.

- Your postal address.

- Your e-mail address.

- Your telephone/mobile number.

By completing your registration, you acknowledge having read, understood and agreed to be bound by the terms of use, along with the privacy policy, as they may be amended from time to time, which are hereby incorporated and made an integral part of this Agreement.

SERVICES:

The Services constitute a technology platform that enables users of Buffet’s mobile application or website to arrange and schedule restaurant reservations, catering services booking or delivery services with Third-Party Providers of such services, subject to an Agreement with Buffet.

LIABILITIES:

You should be aware that Buffet does not function as a restaurant or catering service. However, Buffet is a mediator that connects the “Customer” with the Third-Party Providers in order to undertake the agreed upon booking/reservation/catering service to the concerned Customer.

Buffet services shall be used upon the Customer’s request and schedule (restaurant reservations /catering services) with (“Third Party Providers”). On the other hand, the Customer acknowledges that Buffet has no responsibility or liability to any of such services provided to the Customer by (“Third Party Providers”) through the use of the Services other than as expressly set forth in these terms.

Buffet does not guarantee the suitability, safety or ability of third-Party Providers, it is solely the Customer’s responsibility to determine if a third-Party provider will meet the Customer`s needs and expectations.

Moreover, Buffet shall not participate in disputes between the Customer and a third-Party Provider. Whereas, by using the said Services the Customer acknowledge the potential risks of the Third-Party Providers. Accordingly, the using of the Services is at the Customer’s risk and judgment, Buffet shall not have any liability arising from or in any way related to the Customer’s transactions or relationship with Third Party Providers.

Buffet is hereby authorized to use the location-based information provided by any of the telecommunication companies when the Customer uses the mobile phone to make a reservation or booking of catering service, the location-based information will be used only to facilitate and improve the probability of locating the Customer`s location so that the “Third Party Provider “can reach the Customer and perform the desired Service.

Buffet shall be entitled to disclose to all companies within its group, or as so required by the law or by directive or requested from any governmental body, the particulars of the customer in the possession of Buffet in any way as Buffet in its absolute discretion, deems suitable, or if it considers it in its interests to do so.

Any complaint in respect of the Services, the Customer has to inform Buffet of the said complaint in writing within the 24 hours of using Buffet mobile application or websites for the booking of catering services/restaurant reservations in order to enhance our services in future deals.

Buffet shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at Buffet`s website ………… on the date that Buffet may indicate that such addition, variation or amendment shall come into effect.

BUFFET WARRANTY:

Buffet shall provide its services and meet its obligations under this Agreement in a timely and workmanlike manner, using knowledge and recommendations for performing the services which meet generally acceptable standards in the Service Provider's community and region, and will provide a standard of care equal to, or superior to, care used by service providers similar to Buffet on similar projects.

All the calls made to Buffet call center shall be recorded by Buffet for quality and training purposes in the event the Customer places a query on our application/website including query with respect to our Services, applicable fees or terms of Service, you hereby expressly agree to consent to receive our responses, whether by way of telephonic calls or electronic mail or any other suitable means of electronic communication, to such query and all related information with respect to our Services. For removal of doubts, related information shall include without limitation any marketing and/or commercial information. You understand and agree that such information shall in no event qualify as unsolicited commercial communication under any other applicable law.

CANCELLATION POLICY:

Cancellations can be made any time after booking/reservation and valid until 24/48 hours only before the scheduled date depending on the restaurant policy, otherwise cancellation will incur a cancellation fee. Cancelling two bookings/reservations after “Third Party Providers” allocation in a day will temporarily block your account for a period decided by Buffet. Your account will be re-activated post that period.

If the provider could not reach the customer through the mobile phone and/or the customer was not in the place and time of receipt/delivery of the service, the down-payment will be deducted, and compensation will be claimed if required.

THIRD PARTY SERVICES AND CONTENT:

The Services may be made available or accessed in connection with “Third Party Providers” and content (including advertising) that Buffet does not control, you acknowledge that different terms of use and privacy policies may apply to you or use of such Third-Party services and content, Buffet doesn’t endorse such Third-Party services and content and in no event shall Buffet be responsible or liable for any products or services of such Third-Party providers.

USE OF THE SERVICES:

Subject to the Customer`s compliance with this Agreement, Buffet grants the Customer`s and its subsidiaries (in case of an entity) a limited, non-exclusive, non-sub licensable, revocable, non- transferrable license to:

(i) Access and use the Applications solely in connection with the provision of the Services;

(ii) Access and use any content, information and related materials that may be made available through the Services; 

(iii) Access and use the website interface and Applications solely in connection with the provision of the Services. Any rights not expressly granted herein are reserved by Buffet and may be revoked at any time.

Intellectual Property Rights:

The Customer or its Subsidiaries may not remove any copyright, trademark or other proprietary notices belonging to Buffet from any portion of the Services, reproduce, modify , prepare , publicly perform, transmit , stream , broadcast, or otherwise exploit the Services except as expressly permitted by Buffet in writing , decompile, reverse engineer or disassemble the Services except as may permitted by applicable law lint to mirror or frame any portion of the Services cause or launch any programs or scripts for the purpose of scraping , indexing surveying or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services or attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.

USER ACCOUNTS:

In order to use most aspects of the Services, you must register and maintain an active personal user Services account (“Accounts”). You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to obtain an Account.

Account registration requires you to submit to Buffet certain personal information, such as your name , address, mobile phone number and age, etc. , as well as at least one valid credit card, You agree to maintain accurate, complete, and up to date information in your Account, your failure to maintain accurate , complete, and up to date Account information, including having an invalid or expired credit card on file, may result in your inability to access and use the Services or Buffet’s termination of this Agreement with you , You are responsible for all activity that occurs under your Account, and as such, You agree to maintain the security of your Account username and password at all times, Unless otherwise permitted by Buffet in writing.

ELECTRONIC COMMUNICATIONS:

By creating an Account, you agree that you are communicating with us electronically. Therefore, you consent to receive communications from us electronically.   the Services will communicate with you via e-mail or may send you information text (SMS) messages, as well as by posting notices on the application/website as part of the normal business operation of your use of the Services, you acknowledge that opting out of any of the said means of communication  may impact your use of the Services.

CONFIDENTIALITY:

User(s) shall not disclose any information received under the contract of service with Buffet to any third party. Access to any information which pertains to business of Buffet shall be kept confidential to the extent it might adversely impact Buffet`s business. User(s) shall be liable to indemnify Buffet against any loss of business or reputation due to the act of the user(s).

DISCLAIMERS:

The information contained in this application/website is for general information purposes only, the information provided by Buffet while we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

The Services are provided “as is” and “as available.” Buffet disclaims all representations and warranties, express, implied or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement, in addition, Buffet makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of the Services or any services or goods requested through the use of the Services, or that the services will be uninterrupted or error-free, Buffet does not guarantee the quality, suitability or ability of third party providers, you agree that the entire risk arising out of your use of the services, and any services or good requested in connection therewith , remains solely with you, to the maximum extent permitted under applicable laws.

LIMITAION OF LIABILITY:

Buffet shall not be liable to you for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage, even if Buffet has been advised of the possibility of such damages, Buffet shall not be liable for any damages, liability or losses incurred by third party arising out of your use of or reliance on the services or your inability to access or use the services or any transaction or relationship between you and any third party provider, even if Buffet has been advised of the possibility of such damages , Buffet shall not be liable for delay or failure in performance resulting from causes beyond Buffet`s reasonable control, you acknowledge that third party service providers providing catering services request through Buffet are solely liable and responsible for any damages that may occur during the provision of services by third party including but not limited to torts, personal injury, or property damage.

These limitations do not purport to limit liability that cannot be excluded under the applicable laws.

INVOICING AND PAYMENT TERMS:

Payment must be made to Buffet on the completion of the Service that was requested in a booking/reservation in a form acceptable to Buffet Cash is an acceptable form of payment through Buffet’s courier.

Paying through Credit/Debit Card

In Catering and Restaurant reservation services, orders shall only be confirmed after paying the down payment, whether through credit card or Buffet’s courier The rates and surcharges and other conditions used for the purpose of invoicing are those that are in effect at the time the reservation was made. Buffet provides a breakdown which fully details all charges.

INSURANCE POLICY: 

Buffet does not include any charges towards insurance, Buffet is not responsible for insuring any goods that are transferred by third party providers that has been requested through Buffet`s platform, the Customer may obtain a third-party insurance on the goods under his own responsibility, if the Customer has obtained an insurance for his order/shipment from a third party, the customer has to inform us that he/she wished to lodge an insurance claim and the next steps as advised by his Insurer, if required we can help in the survey process initiated by the insurer of the customer, we can provide a certificate of facts which is an important document for claiming the insurance.

INDEMNIFICATION:

You agree to indemnify and hold Buffet, its affiliates, sponsors, partners, directors, officers and employees harmless from and against, and to reimburse Buffet with respect to, any and all losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) arising out of or relating to your breach of this Terms and Conditions, along with our privacy policy or use by you or any third party of the Services.

FORCE MAJEURE:

Buffet will not be liable for any delay, interruption or failure in the provisioning of services if caused by acts of God, including but not limited to: declared or undeclared war, fire, flood, storm, slide, earthquake, power failure, the inability to obtain equipment, supplies or other facilities that are not caused by a failure to pay, labor disputes, or other similar events beyond our control that may prevent or delay service provisioning.

UNENFORCEABLE PROVISIONS:

If any part of this Terms and Conditions is found to be invalid or unenforceable under applicable laws, such part will be ineffective to the extent of such invalid or unenforceable part only, without affecting the remaining parts of the Terms and Conditions in any way what so ever.

GOVERNING LAW:

The rights and obligations of the parties pursuant to this Terms and Conditions are governed by, and shall be construed in accordance with, the laws of the Arab Republic of Egypt.

You may be subject to other local, provincial or state and national laws. You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the Arab Republic of Egypt for any dispute arising under or relating to this Terms and Conditions and waive your right to institute legal proceedings in any other jurisdiction. We shall be entitled to institute legal proceedings in connection with any matter arising under this Terms and Conditions in any jurisdiction where you reside, do business or have assets.

WAIVER:

No waiver of any of the provisions of this Agreement will be deemed to constitute a waiver of any other provision nor shall such a waiver constitute a continuing waiver unless otherwise expressly provided in writing duly executed by the party to be bound thereby.

ENTIRE AGREEMENT:

This Agreement along with the Buffet’s Privacy Policy, as may be updated from time to time and posted at [The company’s website], constitutes the complete agreement and understanding between us with respect to the Service and supersedes any other form of Agreement.

Restrictions for Non-Commercial use:

You hereby agree that any commercial use of this content may lead to monetary compensation and legal liability, and Buffet shall take all the necessary legal measures to protect its rights.
